Given recent findings and questions from the field, the ESS/Program Support & Monitoring Hot Topic reviews the requirements for English Learners (ELs) under the IDEA. Specifically, July’s Hot Topic addresses the requirements for consideration of EL with regard to eligibility determination and IEP development.
Additionally, there have been some changes regarding EL testing requirements provided to the field by ADE/OELAS. The OELAS communication, “ELs with Disabilities,” explains the testing and exiting requirements for all ELs, including those with disabilities. Also of note is the guidance document, “EL and Title III Addendum,” recently released by the USDOE, addressing EL requirements.
ESS realizes this is a complex issue and wants to assist however we can. We are planning on including ELs and Students with Disabilities as a topic on the upcoming Talk with ADE schedule. Additionally, per the ADE/OELAS communication, an ADE EL/Special Education Taskforce will be convened in the fall to discuss these issues.

To ensure compliance with federal reporting and program requirements for fiscal year 2019, all public education agencies (PEAs) in Arizona were required to bring special education policies and procedures (P & P) into compliance with current statutory requirements.
- Assurances indicating these updates were made to local special education P & P were required when PEAs initially completed IDEA Entitlement grant applications for FY 2019.
- The deadline for submission of verification of board-approved updated P & P and/or revised P & P was initially set for Fall 2018. In response to field feedback and the delay of guidance from public school governing board advisor groups, ADE/ESS moved the deadline to Monday, January 2, 2019 at 5:00 p.m.
Please be advised, if your PEA has not yet submitted either verification of board-approval and/or a copy of updated special education P & P, IDEA Entitlement funds will be placed on hold. The hold will be released when documentation is received by ADE/ESS.

The ADE/ESS is pleased to announce that the Arizona Monitoring Manual (2018- 2019) is now available on the ESS/Program Support and Monitoring website. This includes updates and enhancements based on feedback provided to ESS, as well as updates based on statutory changes. The manual can be accessed here.
As a reminder, in an effort to “go green,” and in response to the large number of unclaimed and printed manuals in years past, ESS will not be printing paper copies of the manual for PEAs.
