PS & MONITORING: HOT TOPIC: In-Person Special Education Services Under the Governor’s Executive Orders

Special Education Directors,

ADE/ESS has received a number of requests for clarification related to the Hot Topic issued following Executive Order 2020-51 (In-Person Special Education Services Under the Governor’s Executive Orders).

This Questions and Answers document, designed to be a companion resource with the Hot Topic, has been developed to address questions and provide clarification. Both the Hot Topic and the Q & A companion document will be added to the ESS SY 2020—2021 School Reentry webpage, in a new “Hot Topic” tab, as well as incorporated within the Q & A section.

Please note that this is an evolving situation and answers are subject to revision as things change. PEAs are strongly encouraged to consult their legal counsel for student-specific questions.

ESS appreciates the tremendous efforts being made by PEAs to respond to guidance provided at the State level.

The Arizona Department of Education, Exceptional Student Services (ADE/ESS), has been asked a variety of questions by public education agencies (PEAs) about in-person special education services under the recent Executive Orders (EOs) provided by the Governor (EO 2020-41, EO 2020-44, and EO 2020-51). This is a Hot Topic outlining the impact of these Executive Orders on in-person special education services.

PD INFO: Special Education Check-In Meeting – Thursday, July 23

Special Education Directors,

 Please join ADE/ESS for the next session in our summer series of Special Education Director Check-Ins on Thursday, July 23, from 1:30 p.m. to 2:30 p.m.

This week’s topic is Critical Updates for School Reentry, which will include an overview of recently issued Hot Topics (ESY/Comp Ed Services, Electronic Signatures, and more),  Virtual Learning Tools & Considerations, Discussion of Homebound vs. Home Placement, and Data Reporting in a Virtual Environment. There will be a lot of information packed into this Check-In, you won’t want to miss it!

The final summer series Check-In will be scheduled from 1:30 p.m. to 2:30 p.m. on August 6, unless any unavoidable conflict arises. Based on overwhelming positive feedback, virtual Check-Ins will continue during the 2020-2021 school year – the schedule is currently being developed and will be sent via the Special Education Director list serv when it is finalized.

Below is a Hot Topic to address questions from the field in light of the Governor’s June 29, 2020 Executive Order considering Compensatory Educational Services and Extended School Year Services. ADE/ESS provides guidance based on interpretation of current Executive Orders, as well as federal and state regulations. Please consult with your district/charter legal counsel to determine how to implement service delivery in your schools.

PD INFO: Special Education Check-In Meeting – Thursday, June 11 – TIME CHANGE

Special Education Directors,

Please join ADE/ESS for the next session in our summer series of Special Education Director Check-Ins on Thursday, June 11, from 11:30 p.m. to 12:30 p.m. NOTE: This is a one-time change to accommodate other conflicts on this particular day.

This week’s topic is IDEA Programmatic Monitoring (Part 1) and presenters will give an overview of what the IDEA requires for programmatic monitoring and how ESS has designed its system to meet IDEA requirements and to ensure FAPE for students with disabilities is provided at the PEA level.

COVID-19 and PD INFO: Special Education Director Check-In Schedule Change and Survey Need

Special Education Directors,

As we approach the end of the “school year,” ADE/ESS is changing the summer schedule (May 18 through August 7) for the Special Education Director Check-Ins to every two weeks. The next Check-In is scheduled for Thursday, May 28 from 1:30 p.m. to 2:30 p.m. and the topic will be “IDEA Fiscal Update.” There will be no Special Education Director Check-in this week (May 21).

Additionally, the Thursday Afternoon LEarning Series (TALES) will be moving to every two weeks for the summer. However, there IS a TALES session this Thursday, May 21 from 3:00 p.m. to 4:00 p.m., and the topic is: “I Want SMORE of That! A Free Tool for SLPs, Teachers, and Other Related Service Providers during COVID-19 and Beyond.”
